Police were reportedly considering child abuse charges “before” the death of Emilie Kiser and husband Brady Kiser‘s 3-year-old son.
Arizona Central reported on Tuesday, July 15, that court records indicated police had been considering pursuing the charge ahead of Trigg’s death in May. (Trigg was found unconscious in their family pool on May 12. The Chandler, Arizona, Police Department confirmed to Us Weekly on May 18 that he died. It’s unclear when prior to Trigg’s death the child abuse charge was considered.)
News broke on Tuesday that the Chandler Police Department had submitted a criminal charge recommendation for Brady.
“The Chandler Police Department has completed its investigation into the tragic drowning of three-year-old Trigg Kiser. Following a thorough review of the evidence, investigators have recommended a Class 4 felony charge of child abuse against Brady Kiser,” the statement read. “The case has now been submitted to the Maricopa County Attorney’s Office for review.”

One month prior, Brady told authorities he was home alone watching both Trigg and now 3-month-old son Teddy while Emilie was out with friends, per search warrant applications obtained by USA Today. (Sources close to the litigation shared with Us that Emilie was not home at the time of the accident.)
Brady shared that his eldest son went to the backyard to play after he finished eating. He noticed that Trigg was playing near the pool — something police records indicated was “not uncommon.” Brady explained that the pool typically had a protective cover on it.
He claimed he became “soon distracted” by son Teddy and lost sight of Trigg for three to five minutes. Brady later found Trigg floating in the pool and proceeded to jump in and call 911, per the applications. The records noted that investigators filed the search warrant applications on May 13 to obtain video surveillance from two outdoor cameras in the backyard to align with his statement. The Chandler, Arizona, Police Department confirmed to Us in May that Trigg died after being pulled unconscious from the family’s backyard pool.
Emilie, for her part, has yet to address her son’s death or the investigation. In May, the influencer filed a lawsuit asking the court to block the release of records about Trigg’s death.
A judge ruled in May to give Emilie temporary confidentiality on her request for privacy “until a determination is made that balances the public’s need for information vs privacy interests,” in court documents obtained by Us.
