Police use ‘yellow flag’ law to take Penobscot County man’s guns after alleged drunken rampage

Penobscot County sheriff’s deputies arrested a man on Saturday and ultimately had his guns removed after he allegedly damaged a house during a family fight, made threats and drove away drunk.

William Smith, 48, had left the Lowell residence by the time police arrived and had allegedly threatened to come back with a gun, according to the sheriff’s office.

While speaking with the witnesses at the house, the deputies heard a pickup engine revving then saw a white pickup on West Old Main Road coming toward them, the sheriff’s office said. The witnesses confirmed Smith was driving the truck.

Deputies chased after Smith and found his truck stuck in a snowbank at the intersection of Lowell Road and Cedar Rest Road. They arrested Smith for allegedly operating under the influence of intoxicating liquor.

A witness later reported finding all three firearms on the property: two handguns on the garage floor and a rifle lying in the snow in the driveway.

Based on the “totality of the circumstances,” the sheriff’s office’s Criminal Investigation Division completed the Extreme Risk Protection Order, or “yellow flag,” process, and the guns were removed from Smith’s residence.

Smith bailed out of Penobscot County Jail on Sunday.
