
A man accused of shooting a man in Glenburn was arrested again days after he was released from jail.
Brandon Harvey, 43, was arrested June 10 after he allegedly shot another man in the abdomen. He was released from the Penobscot County Jail after posting $200,000 bail on June 16.
On Tuesday, Harvey was pulled over by Brewer police because he can be searched without reasonable suspicion as part of his bail conditions. During that search, police said they found illegal drugs, including fentanyl, in Harvey’s wallet.
Police arrested Harvey for allegedly violating his bail conditions and possession of illegal drugs, according to Penobscot County Superior Court records.
Harvey’s bail was revoked by Judge Bruce Mallonee during a hearing Wednesday afternoon. It is concerning that eight days after being released from jail, Harvey is allegedly found with illegal drugs, Mallonee said.
Harvey appears to be unwilling to comply with the terms of his bail, Penobscot County Deputy District Attorney Mark Rucci said while asking for bail to be revoked.
There was a “residue” amount of drugs allegedly found in Harvey’s wallet and the new charges are misdemeanors, said Erik Paulson, a lawyer representing Harvey for the bail hearing. He asked the judge to set a cash bail.
The man Harvey is accused of shooting was placed on a ventilator and is still “very touch and go” during his recovery, Rucci said. Rucci also pointed to the fact that the house the shooting happened at is a suspected drug location and was under investigation by Maine Drug Enforcement Agency and Homeland Security Investigations.
Harvey allegedly fled the scene after the June 9 shooting. He was found by police and arrested a day later.
The passenger in the car Harvey was driving on June 24 also had illegal drugs and was arrested, Brewer police said.
Harvey is scheduled to appear in court Sept. 9. He is being held in the Penobscot County Jail.
