A Holden man is back behind bars after he allegedly violated his house arrest after a hit-and-run conviction.
David MacKenzie, 53, has been charged with violating his conditions of release, according to the Holden Police Department.
On July 15, 2023, MacKenzie had drunk 12 22-ounce beers in about six hours at a Brewer bar when he got behind the wheel to drive home. During the drive, MacKenzie struck then-87-year-old Ira Williams of Brewer on Eastern Avenue in Brewer about 8:39 p.m., leaving Williams with lasting injuries.
MacKenzie fled the scene, but during his trial last year, his defense attorney told the court that MacKenzie didn’t realize he had hit Williams.
A jury found him guilty of aggravated operating under the influence, aggravated assault, leaving the scene of an accident causing serious bodily injury or death, and operating under the influence.
In October 2024, MacKenzie was sentenced to six years in prison with all but 15 months suspended, as well as three years of probation, a $2,100 fine and a six-year license suspension.
MacKenzie was out on post-conviction bail when he violated his bail conditions and was placed under house arrest, Holden police said Monday morning.
Then Holden police received a tip that MacKenzie was allegedly violating the conditions of his house arrest and contacting a witness in the hit-and-run case. On Saturday, police saw MacKenzie and the witness pull into MacKenzie’s home about 9:30 p.m.
When police tried to get MacKenzie to come out of the house, he allegedly refused to. Officers eventually forced their way inside, where they arrested MacKenzie. The witness was found hiding inside, according to Holden police.
MacKenzie is being held without bail at the Penobscot County Jail in Bangor.
